The Society for Women’s Health Research (SWHR) responded to a Request for Information (RFI) from the National Institute of Standards and Technology (NIST) on the Draft Interagency Guidance Framework for Considering the Exercise of March-In Rights, which reviews the factors that an agency may consider when deciding whether to exercise march-in rights. Within its comments, SWHR noted that while it appreciated the intent of the administration, it was concerned that introducing pricing as a basis for “march-in” criteria under the Bayh-Dole Act of 1980 has the potential to discourage the public-private collaborations and hinder scientific progress.
